Terms & Conditions
Product and Service Description
The customer agrees to purchase the product specified in the order form.
The product and service include the delivery, installation, and testing of the appliance, as well as any accessories and venting materials.
The product and service do not include any electrical or gas line work, which will be performed by a licensed contractor or tradesperson at the customer's expense.
The product and service are subject to the availability of the appliance and the scheduling of the installation.
Payment and Cancellation
The customer agrees to pay a deposit of 50% of the total price at the time of placing the order.
The deposit guarantees the product and service for 90 days at the above price.
The customer agrees to pay the remaining balance on the day of pick up or installation.
The customer may cancel the order at any time before the installation but will incur a cancellation fee/restocking fee of 10% of the price.
The customer may request a change in the order but will be subject to any additional costs or delays.
The customer will receive an invoice with the final price, which may vary from the quoted price depending on the actual materials and labor required.
The prices quoted are valid for 90 days from the date of the order.
Building Permits and Regulations
The customer is responsible for any cost associated with obtaining necessary building permits.
The Customer is responsible for complying with any local codes and regulations for the installation of the appliance.
Fallon’s Home and Hearth, or the contractor/tradesperson responsible for that portion of the work, will fill out and provide the required documentation for the building permits.
The customer agrees to allow Home and Hearth, or the contractor/tradesperson, to access the property and perform the installation according to the specifications and standards.
The customer agrees to notify Home and Hearth, or the contractor/tradesperson, of any defects or problems with the installation within 24 hours of completion.
Warranty and Service
The customer will receive a manufacturer's warranty for the appliance, which covers any defects in materials or workmanship for a specified period.
The customer agrees to follow the manufacturer's instructions and recommendations for the proper use and maintenance of the appliance.
The customer agrees to contact Fallon’s Home and Hearth for any warranty claims and provide proof of purchase and warranty.
Labor for service performed during warranty period of product will receive a discount from the manufacturer. See Manufactures warranty for discount amount. The customer agrees to pay standard labor rates minus the discount from the manufacturer if they should require a service call during warranty period.
The customer understands that the appliance is sold as a secondary heat source/supplement, and that the primary heating source, such as gas, propane, oil, or electric furnace or boiler, is required by most homeowners' insurance.
The customer understands that for pellet installs, a surge protector, supplied by the customer, is highly recommended.
The customer understands that for inserts, any gas, wood, or pellet inserts require the chimney to be professionally cleaned prior to install.
Disclaimer and Signature
This sales agreement constitutes the entire agreement between the customer and Fallon’s Home and Hearth and supersedes any prior or contemporaneous oral or written agreements or communications.
This sales agreement may not be modified or amended except by a written document signed by both parties.
By signing this sales agreement, the customer acknowledges that they have read, understood, and agreed to all the terms and conditions.
The customer also acknowledges that they have received a copy of this sales agreement and the warranties.
